Terms of Service
   
This service may only be utilized only for lawful purposes, and the usage of the service in connection with or adjunct to any matter or thing which violates any municipal, state or federal statute or regulation is prohibited.

Specifically, customer agrees that no pornographic material, nor any material considered offensive, racist, or unsuitable for audiences under 18 will be uploaded to the server.

Customer agrees to abide by generally accepted "netiquette". (NO Spamming - we are spam hostile) Customer agrees to indemnify and hold harmless NewCreations from and against any and all claims, actions, causes of actions, losses or damages (including legal fees) arising from the usage by Customer of the service in violation of this paragraph.

Unilateral Service Revocation: In the event that NewCreations may at any time believe that the service is being utilized by the Customer in contravention with the terms and provisions defined above, NewCreations may immediately discontinue such service to Customer without liability, and without the refund of unearned prepaid service fees.

It is contrary to NewCreations policy for any user of our services to effect or participate in any of the following activities through a NewCreations.net-provided service:

1.To post a single article or advertisement to more than five (5) Usenet or other newsgroups, forums, email mailing lists or other similar groups or lists;

2.To post to any Usenet or other newsgroup, forum, email mailing list or other similar group or list articles which are off-topic according to the charter or other owner-published FAQ or description of the group or list;

3.To send unsolicited mass emailings to more than ten (10) email users, if such unsolicited emailings provoke complaints from the recipients; or to subscribe others to a mailing list without their request or explicit permission;

4.To engage in any of the foregoing activities using the service of another provider, but channeling such activities through a NewCreations account or remailer, or using a NewCreations account as a maildrop for responses;

5.To falsify user information provided to NewCreations or to other users of the service in connection with use of a NewCreations service.

6.To use the NewCreations.net name, or your NewCreations hosted Domain Name/ Email address in unsolicited bulk email (both as a Reply to: and as the From: Header), or advertise your NewCreations hosted Website via Unsolicited Bulk Email as defined above, regardless of whether the Bulk Email travels through the NewCreations mail gateway, your own SMTP, or that of your local ISP or an independent bulk email service.

NewCreations considers the above practices to constitute abuse of our service and of the recipients of such unsolicited mailings and/or postings, who bear the expense. Therefore, these practices are prohibited by NewCreations's terms and conditions of service.

Engaging in one or more of these practices will result in termination of the offender's account and access to NewCreations hosting services. In addition, NewCreations reserves the right, where feasible, to implement technical mechanisms which block multiple postings as described above before they are forwarded.

This policy addresses only the kinds of network abuse specifically enumerated above. In addition to these activities, NewCreations terms and conditions of service also prohibit other forms of abuse such as harassment and the posting of illegal or unlawful materials, and NewCreations will respond as appropriate to these other activities as well.

Nothing contained in this policy shall be construed to limit NewCreations actions or remedies in any way with respect to any of the foregoing activities, and NewCreations reserves the right to take any and all additional actions it may deem appropriate with respect to such activities, including without limitation taking action to recover the costs and expenses of identifying offenders and removing them from the NewCreations service.

In addition, NewCreations reserves at all times all rights and remedies available to it with respect to such activities at law or in equity.

The owner of the TV may watch the TV station's signal or not. It's his TV. He makes no agreement with the TV station, the station's signal is broadcast. He may watch the station's signal because it has been broadcast, and if he tunes to the TV station, he grants permission for the station to play it's signal on his TV.

However, channel 2 may not interfere with channel 13's signal. Channel 2 does not have the right to broadcast on channel 13. If the TV owner tunes to channel 13 and see's channel 2, channel 2 is trespassing on channel 13's signal.

This is a fax machine. It belongs to me. It's connected to the phone network so my friends can send me faxes. You may not connect to my fax machine and use it to advertise. You may not connect to my fax machine to make a free-speech statement. I may grant you permission to use my fax machine. I may sell you permission to use my fax machine. I may deny you permission to use my fax machine. It's MY FAX MACHINE!!!

This is an email box. It belongs to me. It's connected to the internet so my friends can send me messages. You may not connect to my email box and use it to advertise. You may not connect to my email box in order to make a free-speech message. I may grant you permission to use my email box. I may sell you permission to use my email box. I may deny you permission to use my email box. It's MY EMAIL BOX!!!

Is this sinking in? You can't have capitalism and at the same time deny private property. Private property and capitalism go hand in hand.

You may not use anything which belongs to me without my permission. Period. If you use my property to advertise without my permission, you are trespassing, plain and simple.
