Customer agrees to abide
by generally accepted "netiquette". (NO Spamming - we are spam hostile)
Customer agrees to indemnify and hold harmless NewCreations from and against
any and all claims, actions, causes of actions, losses or damages (including
legal fees) arising from the usage by Customer of the service in violation
of this paragraph.
Unilateral Service Revocation:
In the event that NewCreations may at any time believe that the service is
being utilized by the Customer in contravention with the terms and provisions
defined above, NewCreations may immediately discontinue such service to Customer
without liability, and without the refund of unearned prepaid service fees.
It is contrary to NewCreations
policy for any user of our services to effect or participate in any of the
following activities through a NewCreations.net-provided service:
1.To post a single article
or advertisement to more than five (5) Usenet or other newsgroups, forums,
email mailing lists or other similar groups or lists;
2.To post to any Usenet
or other newsgroup, forum, email mailing list or other similar group or list
articles which are off-topic according to the charter or other owner-published
FAQ or description of the group or list;
3.To send unsolicited
mass emailings to more than ten (10) email users, if such unsolicited emailings
provoke complaints from the recipients; or to subscribe others to a mailing
list without their request or explicit permission;
4.To engage in any of
the foregoing activities using the service of another provider, but channeling
such activities through a NewCreations account or remailer, or using a
NewCreations account as a maildrop for responses;
5.To falsify user information
provided to NewCreations or to other users of the service in connection with
use of a NewCreations service.
6.To use the NewCreations.net
name, or your NewCreations hosted Domain Name/ Email address in unsolicited
bulk email (both as a Reply to: and as the From: Header), or advertise your
NewCreations hosted Website via Unsolicited Bulk Email as defined above,
regardless of whether the Bulk Email travels through
the NewCreations mail gateway, your own SMTP, or that of your local
ISP or an independent bulk email service.
NewCreations considers
the above practices to constitute abuse of our service and of the recipients
of such unsolicited mailings and/or postings, who bear the expense. Therefore,
these practices are prohibited by NewCreations's terms and conditions of
service.
Engaging in one or more
of these practices will result in termination of the offender's account
and access to NewCreations hosting services. In addition, NewCreations reserves
the right, where feasible, to implement technical mechanisms which block
multiple postings as described above before they are forwarded.
This policy addresses
only the kinds of network abuse specifically enumerated above. In addition
to these activities, NewCreations terms and conditions of service also prohibit
other forms of abuse such as harassment and the posting of illegal or unlawful
materials, and NewCreations will respond as appropriate to these other activities
as well.
Nothing contained in this
policy shall be construed to limit NewCreations actions or remedies in any
way with respect to any of the foregoing activities, and NewCreations reserves
the right to take any and all additional actions it may deem appropriate
with respect to such activities, including without limitation taking action
to recover the costs and expenses of identifying offenders and removing them
from the NewCreations service.
In addition, NewCreations
reserves at all times all rights and remedies available to it with respect
to such activities at law or in equity.

can't have capitalism and at the same time deny private property. Private
